The "indoorlight.com" online store was created and is operated by the company G.W.I.

These General Conditions of Sale apply, without restriction or reservation, to all sales concluded by the company G.W.I with non-professional buyers, wishing to acquire the products offered for sale by the Seller on its website indoorlight.com .

These conditions apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.

These General Conditions of Sale are accessible at any time on this website and will prevail, if necessary, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded by the company G.W.I constitutes proof of all transactions.

In accordance with Article L.111-1 of the Consumer Code, the content of "indoorlight.com" allows the customer, before concluding an order, to know the essential characteristics of the product(s) selected.

Product offers are within the limits of available stocks. The indications on the availability of the products are provided at the time of placing the order.

The modifications of these General Conditions of Sale are opposable to the users of the site as from their posting on line and cannot apply to transactions concluded previously.

Validation of the order by the buyer implies unreserved acceptance of these General Terms and Conditions of Sale.

ARTICLE 2 - Right of withdrawal

The Buyer has, in accordance with the provisions of Article L 121-21 of the Consumer Code, a period of 14 working days from the delivery of the products to inform the company G.W.I of his intention to exercise his right of withdrawal. The buyer must then return them to the Seller for exchange or refund, provided that the products are returned in their original packaging and in perfect condition within 14 days of the communication of their decision to withdraw. . Damaged, soiled or incomplete items will not be refunded or exchanged. Return costs will be the sole responsibility of the Buyer. The return of the products must be accompanied by the invoice. The exchange (subject to availability) or refund will be made within 14 working days of receipt by the Seller of the items returned by the Buyer. The refund will be made according to the initial method of payment, by credit card or by bank transfer.

For health reasons, products for oral use (such as chichas, puffs, etc.) are neither taken back nor exchanged. ARTICLE 3 – Validation of orders

It is up to the Customer to select the products he wishes to order on the site.

Any purchase order signed by the customer by "double click" constitutes an irrevocable acceptance which can only be called into question in the cases limitedly provided for in these general conditions of sale such as the right of withdrawal and out of stock.

According to the law of March 13, 2000 on electronic signature, from the moment the customer registers his order or "double clicks" on any order form, the customer's order is considered accepted knowingly and irrevocably, both by prices, volumes and quantities.

Acceptance of the order is subject to payment and collection thereof in full.

In the event of cancellation of the order by the Customer after its acceptance by the Service Provider, beyond the 14 days resulting from the right of withdrawal, for any reason whatsoever except force majeure, an amount corresponding to 10% of the total invoice will be acquired by the Service Provider, as damages, in compensation for the damage thus suffered.

ARTICLE 4 – Price

The products are supplied at the current prices appearing on the site, when the order is recorded by the Seller.

The prices are expressed in Euros and include VAT (all taxes included), with the exception of deliveries to countries outside the European Union where the prices are expressed in Euros or in foreign currencies and excluding VAT (excluding taxes), all costs, duties and taxes related to customs clearance operations are the responsibility of the Customer.

These rates are firm and non-revisable.during their period of validity, as indicated on the Seller's website. They do not include processing, shipping, transport and delivery costs, which are invoiced in addition.

An electronic invoice is established by the Seller and sent to the customer on the email address that the latter has communicated to the Seller.

G.W.I reserves the right to cancel any orders on which the prices would be erroneous following a computer bug, hacking, input error or other internal or external malevolence to the company. ARTICLE 5 - Terms of payment

The price is payable in cash, in full on the day the order is placed by the Buyer.

To pay for his order, G.W.I offers the buyer different payment methods referred to in the order form, namely:

- Bank card with secure payment with Payplug for payments in Euro.

- Secure credit card in 2x, 3x and 4x free of charge with Alma.

Installment/deferred payment is available through our partner Alma. Payment security is provided by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases:

Payment in 2X: Only purchases between €50 and €3,000 are eligible for payment with Alma.

Payment in 3X: Only purchases between €50 and €3,000 are eligible for payment with Alma.

Payment in 4X: Only purchases between €50 and €3,000 are eligible for payment with Alma.

By paying in installments with Alma, the Customer does not pay any fees.

Alma is a tele-payment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 and following of the Civil Code.

Termination: Any termination of the T&Cs that bind the Seller and the customer entails the termination of the T&Cs between Alma and the customer.

Credit card payments are debited when the order is placed.

Any order paid by bank transfer will only be processed upon receipt of payment. Availability and shipping times are to be recalculated from the date of receipt of the means of payment.

The company G.W.I reserves the right to suspend any management of order and any delivery in the event of refusal of authorization of payment by credit card on behalf of the officially accredited organizations, refusal of authorization of payment by check on the part of the private check guarantee company chosen by G.W.I or in the event of non-payment.

The company G.W.I notably reserves the right to refuse to make a delivery or to honor an order from a customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. administration.

G.W.I cannot be held responsible for any embezzlement or fraudulent use of any means of payment that has not been detected by the verification procedure.

G.W.I retains full ownership of the products sold until full receipt of all sums owed by the customer in connection with his order, including costs and taxes.

The transfer of ownership of goods purchased from G.W.I by the customer to a third party will not be borne by the company G.W.I.

Only the original purchaser of this property can claim to access the clauses of these general conditions of sale.

ARTICLE 6 – Shipping / Delivery

Shipping times depend on the type of payment chosen by the customer, the preparation of the order only intervening upon receipt and collection of payment.

The products acquired by the Buyerwill be shipped within a maximum of 5 working days to the address indicated by the Buyer when ordering on the website, subject to available stocks.

In case of unavailability of a product ordered, in particular because of our suppliers, the buyer will be informed as soon as possible and will have the possibility of canceling his order. The buyer will then have the choice of requesting either a refund, where applicable, of the sums paid within 15 days of their payment at the latest, or an exchange of a product of equivalent characteristics and price, if G.W.I is able to get him.

In case of impossibility of exchange, G.W.I reserves the right to cancel the customer's order and to refund the sums paid.

The information on the availability of the products being transmitted by our suppliers, the unavailability of the product could not engage the responsibility of G.W.I nor give right to damages for the customer.

Except in special cases or unavailability of one or more products, the products ordered will be delivered in one go.

Deliveries are made by an independent carrier.

- For Metropolitan France, Corsica and Monaco: 24-hour delivery by Chronopost for orders with a total weight of less than 30kg, delivery 2 to 3 working days by carrier for orders over 30kg

- For international: delivery 5 to 7 working days by Chonopost or Coliposte

- For Overseas: delivery 4 to 8 working days by Coliposte

The delivery of heavy and bulky packages may be sent by carrier.

The Seller undertakes to make its best efforts to deliver the products ordered by the Buyer within the deadlines specified above. However, if the products ordered have not been delivered at the end of the period provided for in the contract, the sale may be canceled at the Buyer's written request. The sums paid by the Buyer will then be returned to him without delay, excluding any compensation or deduction, in accordance with Article L111-1 of the Consumer Code.

In the event of a specific request from the Buyer concerning the conditions of packaging or transport of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to additional specific invoicing, on an estimate previously accepted in writing. by the Buyer.

The products are delivered to the address indicated by the consumer on the order form.

The order will be delivered "curbside" to the entrance of your home or to the main door of the building.

The delivery person will not be able to assist you in handling the item

The customer must verify the completeness and conformity of the information he provides to G.W.I. The latter cannot be held responsible for any errors in data entry and the consequences in terms of delay or error in delivery. In this context, all costs incurred for the reshipment of the order will be entirely the responsibility of the customer.

G.W.I cannot be held responsible for delays in delivery due to errors in the address, telephone numbers communicated by the buyer or in the event of force majeure.

The customer is required to check the condition of the packaging and the contents of the goods upon delivery. Any anomaly concerning the delivery (damage, missing product compared to the delivery slip, damaged package, broken products, etc.) must be indicated on the receipt of the transport slip in the form of "significant and complete handwritten reservations", accompanied by the signature. of the customer, and this in the presence of the deliverer. In the case of a shipment made by La Poste, if the package arrives open or damaged, it is essential that the customer has the postman or the post office on which he depends draw up a "spoliation report" (report 170) so that G.W.I can open an investigation and a compensation procedure.

At the same time, the customer must confirm this anomaly by sending the carrier within two (2) working days following the delivery date, a registered letter with acknowledgment of receipt setting out the said complaints.

The customer must simultaneously notify G.W.I by sending a copy of this letter (with the original of the "spoliation report" if applicable) to: G.W.I - 91 route des romains 67200 Strasbourg or by email to contact@indoorlight.com within two working days. After this period and failing to comply with these formalities, no claim can be validly accepted by the Seller.

Depending on the place of delivery and the amount of the order, the customer may benefit from free delivery. Some products cannot benefit from free delivery due to their weight. A fixed contribution per unit is then invoiced to the customer at the time of the order (this information is indicated at the bottom of the description of the products concerned).

ARTICLE 7 - Delivery errors - Non-compliant products - Return of products

The customer will have to formulate with the company G.W.I at the latest within 48 hours following the delivery, any complaint of error of delivery and/or nonconformity of the products in kind or in quality compared to the indications appearing on the order form. . Any complaint made beyond this period will be rejected without possibility of appeal.

Any complaint to the company G.W.I may be made:

Any complaint not made in the rules defined above and within the time limits cannot be taken into account and will release the company G.W.I from any liability towards the customer.

It is recalled that the customer benefits from the legal guarantee against hidden defects (art 1641 to 1649 of the civil code) and the legal guarantee of conformity (art L211-1 et seq. consumer code). The buyer can act within 2 years from the delivery of the property to act. The buyer can choose between the repair or the replacement of the good within the framework of the guarantee of conformity. When implementing the guarantee against hidden defects, the buyer can choose between rescinding the sale or reducing the sale price in accordance with article 1644 of the civil code.

Any product to be exchanged or refunded must be returned within 14 working days of receipt of the return agreement to the company G.W.I in its entirety (accessories and instructions included) and in its original packaging in perfect condition, by Colissimo Registered with insurance covering the market value of the returned products, to the following address: G.W.I - 14 Rue des Forgerons, 57300 Hagondange.

Any return must be reported in advance to the Customer Service of the company G.W.I. The printed return slip must be slipped inside the package.

The shipping costs advanced by the customer will be reimbursed by the company G.W.I. to the original declaration made by the customer in the return form.

Failure to comply with the above procedure, no claim for non-conformity or apparent defect of the products delivered can be accepted.

The exchange (subject to availability) or refund will be made within 14 working days of receipt by the Seller of the items returned by the Buyer. The refund will be made according to the initial method of payment, by credit card or by bank transfer.

Hygiene and cosmetic health products (including vaporizers), which have been unsealed and/or used by the consumer, cannot be taken back for reasons of hygiene and health protection.

In all other cases, the return of the product will be exclusively the responsibility of the customer.

ARTICLE 8 - Transfer of ownership - Transfer of risks

The transfer of ownership of the Seller's products, for the benefit of the Buyer, will only be carried out after full payment of the price by the latter, and this regardless of the delivery date of the said products.

ARTICLE 9 - Seller's liability - Warranty

The products supplied by the Seller benefit, in accordance with the legal provisions,

- the legal guarantee of conformity,

- the legal guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the products delivered and rendering them unfit for use,

- the Manufacturer's warranty, depending on the products and brands concerned.

Any warranty is excluded in the event of misuse, negligence or lack of maintenance on the part of the buyer, as in the event of normal wear and tear of the property, accident or force majeure and the Seller's warranty is limited to replacement or reimbursement of non-compliant products or products affected by a defect.

In order to assert his rights, the buyer must, under penalty of forfeiture of any action relating thereto, inform the Seller, in writing, of the existence of the defects within a maximum period of 8 days from their discovery.

The Seller will replace or have repaired the products or parts under warranty found to be defective.

The products sold on the website comply with the regulations in force in France. The Seller's liability cannot be engaged in the event of non-compliance with the legislation of the country in which the products are delivered, which it is the Buyer's responsibility to verify.

The Purchaser is solely responsible for the choice of products, their conservation and their use.

The Seller will not be considered responsible or in default for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognized as pby French case law.

All electrical equipment supplied as a kit must be connected by a qualified professional electrician. The responsibility of G.W.I can in no way be engaged in the event of non-compliance with these installation methods.

As an essential condition of the sale, it is recalled that the Buyer is solely responsible in particular for the use of the Seller's Products, their suitability for the use made of them and their destination. The buyer is prohibited from any use of the Seller's Products that would be contrary to public order, to the prescriptions of the Public Health Code, and more generally to the legal or regulatory provisions applicable under French and European law.

Article 10 - Waste Electrical and Electronic Equipment (WEEE) and Extended Producer Responsibility (REP).

A. Electrical and electronic equipment (EEE)

Electrical and electronic equipment (EEE) may contain hazardous substances, these substances have a potential effect on the environment and human health.

End-of-life EEE should not be disposed of with unsorted waste.

Systems for collecting and taking back used Electrical and Electronic Equipment are made available to users.

B. Eco-participation.

When you buy a new electrical or electronic device, you participate in financing the collection, reuse and recycling of old equipment by paying an “eco-contribution”. All EEE prices presented on the site include the amount of the eco-contribution. The collection and recycling of end-of-life electrical appliances is managed by non-profit eco-organizations approved by the public authorities. The amount of the eco-contribution is calculated by these eco-organisations on the basis of the price of the treatment operations necessary for recycling.

C. Collection of WEEE.

As part of the purchase of a new electrical and electronic device, you can return your old device to us free of charge.

You have the possibility to tell us that you want to part with an old device before delivery by simply calling our advisers on 09.77.84.19.85.

Please note: the old device returned must be equivalent to the one purchased, complete, clean, emptied and ready to be loaded by our deliverers.

No dangerous, sharp or broken device will be accepted.

Article 11 - Partial non-validation

ARTICLE 12 - IT and freedoms

ARTICLE 13 - Intellectual property

The content of the site is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.

Any total or partial reproduction of this content is strictly prohibited and is likely toconstitute an offense of counterfeiting.

In addition, G.W.I remains the owner of all intellectual property rights on the studies, drawings, models, prototypes, etc., produced (even at the request of the Client) with a view to providing services to the Client. The Client is therefore prohibited from any reproduction or exploitation of said studies, drawings, models and prototypes, etc., without the express, written and prior authorization of G.W.I, which may condition it on financial compensation.

ARTICLE 14 - Applicable law - Language

By express agreement between the parties, this contract is governed by and subject to French law.

It is written in French. In the event that it is translated into one or more languages, only the French text shall prevail in the event of a dispute.

ARTICLE 15 - Disputes

All disputes to which this contract may give rise, concerning its validity, interpretation, execution, termination, their consequences and their consequences will be submitted to the competent courts under the conditions of common law.
